1. Who we are
These Terms & Conditions ("Terms") govern the relationship between HUX EXPED Pvt. Ltd. ("HUX EXPED", "we", "us" or "our"), a trekking and mountaineering operator registered in Nepal with its office at Thamel, Kathmandu, Nepal, and you (the "Client") when you book, or make an enquiry to book, any trek, peak climb, expedition or related service (a "Trip") through this website or with our team directly.
By placing a booking, paying a deposit or clicking to accept these Terms, you confirm that you have read, understood and agreed to them on behalf of yourself and every member of your party. If you do not agree, please do not book a Trip.
2. Booking and contract
A booking is a request to join a Trip. It becomes a binding contract only once we have confirmed your place in writing (by email or through your account dashboard) and received the required deposit or full payment.
- You must be at least 18 years old to make a booking. Under-18s may join only when accompanied by a responsible adult who accepts these Terms on their behalf.
- You are responsible for the accuracy of the details you provide — names as they appear on passports, dates, dietary and medical information.
- We reserve the right to decline any booking at our discretion, in which case any payment made will be refunded in full.
3. Prices and what is included
Trip prices are shown per person in US Dollars (USD) unless stated otherwise, and are confirmed at the point of booking. Each Trip page lists exactly what is included and excluded; where there is any conflict, the confirmation email prevails.
- Typical inclusions: licensed guides, porters where applicable, permits, in-country ground transport, and accommodation as described on the Trip page.
- Typical exclusions: international flights, Nepal visa fees, travel and rescue insurance, personal equipment, tips, and expenses of a personal nature.
- Prices may change before booking due to fluctuations in permit fees, government taxes, fuel or exchange rates. Once your booking is confirmed and deposit received, the price is guaranteed except for increases directly imposed by government action.
4. Fitness, experience and acknowledgement of risk
Trekking and mountaineering in the Himalaya take place in remote, high-altitude environments. You acknowledge that these activities carry inherent and unavoidable risks, including but not limited to altitude sickness, extreme weather, rockfall, avalanche, difficult terrain, illness and delays, and that medical help and rescue may be hours or days away.
- You confirm that you are in good health and have a level of fitness and experience appropriate to the Trip you have booked, as described on its Trip page.
- You must disclose any pre-existing medical condition, allergy or dietary requirement before departure. We may require a doctor's clearance for certain Trips.
- Our guides have absolute authority on the mountain. For reasons of safety they may alter the route, turn a group back, or require an individual to descend or withdraw. Such decisions are final and no refund is due for the unused portion of a Trip.
5. Insurance
Comprehensive travel insurance is a mandatory condition of joining any HUX EXPED Trip. Your policy must cover trip cancellation, medical treatment, and emergency evacuation (including helicopter rescue) up to the maximum altitude of your Trip. You must provide your policy details before departure. We are not liable for any cost you incur because you were uninsured or under-insured.
6. Changes and cancellation by you
Requests to change or cancel a booking must be made in writing to us. Cancellation charges and refund tiers are set out in our Booking & Cancellation Policy, which forms part of these Terms.
7. Changes and cancellation by us
We plan every Trip carefully, but mountains are unpredictable. We may need to change an itinerary, guide, accommodation or date, and in rare cases cancel a Trip — for example due to insufficient group numbers, extreme weather, natural disaster, political instability or other events beyond our control (Force Majeure).
- For minor changes we will let you know as soon as reasonably possible; no compensation is due.
- If we cancel a Trip for reasons other than Force Majeure, you may choose an alternative Trip of equivalent value or a full refund of monies paid to us.
- Where cancellation or curtailment results from Force Majeure, we will refund what we can recover from our suppliers but cannot guarantee a full refund. This is why insurance is mandatory.
8. Our liability
We accept responsibility for arranging your Trip with reasonable skill and care. We are not liable for injury, illness, death, loss, damage, expense or delay arising from circumstances beyond our reasonable control, from the inherent risks of the activity, or from your own act or omission or failure to follow a guide's instructions.
To the extent permitted by law, our total liability to you in connection with a Trip is limited to the total price you paid us for that Trip. Nothing in these Terms limits liability that cannot be limited by law.
9. Your conduct
We run small, close-knit groups in fragile mountain communities. You agree to behave respectfully towards fellow travellers, our crew and local people, to respect the environment and local customs, and to follow the leave-no-trace principles we brief you on. If your behaviour endangers others or seriously disrupts a Trip, we may require you to leave it with no refund and no liability on our part.
10. Governing law and disputes
These Terms are governed by the laws of Nepal, and the courts of Kathmandu have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have in your country of residence. We would always rather resolve any concern directly and amicably first.
